Description

The U.S. Embassy in Kuwait has a requirement to obtain an urgent services from Al Adwani Law Firm

This justification supports the award of a new Indefinite-Delivery, Indefinite-Quantity (IDIQ) contract for Attorney Services for Real Estate Transactions to Al Adwani Law Firm under a sole-source basis in accordance with FAR 12.102(a) The total estimated cost of this acquisition shall not exceed $75,000.00.


The contract will be established for one year and will provide legal services on an as-needed basis through task orders issued by the Contracting Officer, per the Statement of Work outlined in the IDIQ contract.
Description of Legal Services Required:


The U.S. Embassy Kuwait requires legal services in connection with the acquisition of real estate property for the OBO and FM Buffer Zone Project. These services include but are not limited to:
• Legal advisory on real estate transactions.
• Negotiations with the Government of Kuwait and private entities.
• Drafting and reviewing contracts and legal documents.
• Due diligence and legal risk assessment related to property acquisition.
• Representation in legal matters related to the buffer zone project.


4. Justification for Sole Source and Nature of Requirement:

The sole-source award to Al Adwani Law Firm is necessary due to the following critical factors:
Continuity of Service and Ongoing Negotiations: Al Adwani Law Firm was the contractor for the existing/prior IDIQ contract related to real estate transactions and is uniquely positioned to continue advising the Embassy and OBO on this land acquisition project without interruption. A transition to a new firm at this critical stage could result in delays and potential setbacks in negotiations with the Government of Kuwait.

Historical and Technical Expertise: Al Adwani Law Firm has in-depth knowledge of the buffer zone project, prior transactions, and legal matters related to real estate acquisition for U.S. Embassy Kuwait. Their experience provides a distinct advantage in ensuring smooth negotiations and informed legal counsel.
• Project-Specific Legal Expertise: The nature of this legal requirement involves specialized real estate law, Kuwaiti property regulations, and high-level government negotiations, all of which Al Adwani Law Firm has handled extensively in previous transactions.
