The intent of this notice is to identify qualified and interested Offerors for information and planning purposes.
The information received will be utilized within the Navy to facilitate the decision making process and will not be disclosed outside of the agency. No reimbursement will be made for any costs associated with providing information in response to this announcement or any follow-up information requests. In accordance with Federal Acquisition Regulation (FAR) 15.201(e), responses to this notice are not offers and cannot be accepted by the Government to form a binding contract.
GENERAL INFORMATION:
The Naval Facilities Engineering Command, Far East (NAVFAC FE) intends to issue a solicitation for a Firm Fixed price (FFP) contract for Sidetrack Roadbed Maintenance, Weeding, Inspection of Sidetracks and Maintenance of Electrical Systems at U.S. Government Sidetrack No. 342 and 343, Tsurumi at Commander Fleet Activities Yokosuka, Japan.
The work includes, but is not limited to, Repair and Maintenance, Weeding work, and Emergency repair work for the Roadbed and Electrical systems at the U.S. Government Sidetrack OU-1 (No.343) and OU-2 (No.342) Tsurumi Terminal:
1. Inspection of Roadbed Portion of Sidetrack OU-1 (No. 343)
2. Inspection of Roadbed Portion of Sidetrack OU-2 (No. 342)
3. Inspection of Electrical System of Sidetrack OU-1 and OU-2
4. Emergency Repair
5. Maintenance of Sidetrack OU-1 (No. 343)
6. Maintenance of Sidetrack OU-2 (No. 342)
7. Weeding (OU1 & OU2)
The maintenance and repair services shall be in accordance with (IAW) the Japan Freight Railway Company’s (JFRC) rules and regulations as specified in the Agreement between the United States of America and JFRC for Handling Military Sidetracks, dated 01 Apr 1987, paragraphs 2, 4, 6 and its first Supplementary Agreement dated 13 July 1987, paragraph 5 entitled “Maintenance”, and the second Supplementary Agreement dated 16 March 1988, subparagraphs 5.e and 5.f. All construction debris or waste generated from this contract shall be removed IAW all Japanese laws and regulations, Japan Environmental Governing Standards (JEGS,https://www.usfj.mil/Portals/80/Documents/2020%20JEGS.pdf?ver=mnuvzSujxiVlhHGcY_m65g%3d%3d), commercial practices, and local standards.
CONTRACTOR LICENSING REQUIREMENTS:
Any contract resulting from this solicitation will be awarded and performed in its entirety in the country of Japan. Contractors are required to provide the following information prior to award of contract:
Contractors must be duly authorized to operate and conduct business in Japan and must fully comply with all laws, decrees, labor standards, and regulations of Japan during the performance of the contract. Offerors will be required to provide verification on such license prior to award to the Contracting Officer if such information is not already on file with or available to the Contracting Officer.

STATUS OF FORCES AGREEMENT:
The U.S. Government will not offer “United States Official Contractor” status under Article XIV of the U.S.-Japan Status of Forces Agreement (SOFA) to any Offeror awarded a contract for this requirement. Furthermore, unless specifically provided, the U.S. Government shall not certify any employees of a contractor as “Members of the Civilian Component” under Article I(b) of the SOFA.

Interested firms must submit Attachment 1: Contractor Information Form to John Mack at john.e.mack5.civ@us.navy.mil by the due date and time indicated in SAM.GOV.
Respondents will not be notified of the results of the Navy’s market research. NAVFAC FE will utilize the information for acquisition planning purposes. All data received in response to this Sources Sought Notice marked or designated, as corporate or proprietary information will be fully protected from release outside the Government.
