The fuels listed in this IFB are being sold for energy recovery only, in accordance with the RCRA exemption found
at 40 CFR 261.2(c)(2)(ii). The fuel will only be sold to purchasers that can demonstrate the ability to comply with
all local, state, and federal laws governing the use of off-specification fuels for energy recovery.
