Description
The Environmental Protection Agency (EPA) intends to award a fixed price contract on a sole source basis to PTS Professional Technical Services, Inc. d/b/a EST Analytical for an annual maintenance service agreement (silver) on the Centurion Autosampler and Evolution 2 purge and trap concentrator system.
The requirement is for the analysis of volatile organics with existing EST Analytical equipment operated in the Region 4 laboratory. This service is necessary to avoid unnecessary downtime and lack of adequate knowledge and parts for repairs. The efficient upkeep of the EST Analytical equipment in Region 4’s laboratory protects and maximizes the Agency’s ability to analyze environmental samples quickly and with sufficient quality to protect human health and the environment. The vendor is the only provider of repair and maintenance services capable of providing technical support as needed.
The continued support for systems already in place in the laboratory can only be provided by the original contractor, award to any other source would result in substantial duplication of cost to the government, which is not expected to be recovered through competition. The product specified in this procurement is needed by LSASD and is only available from one manufacturer.
This purchase will be made utilizing Simplified Acquisition Procedures in accordance with Federal Regulation (FAR) Part 13.106-1(b)(1) for purchases not exceeding the simplified acquisition threshold of $350,000.00. Pursuant to the authority granted by 41 U.S.C.253(c) (1), only one responsible source and no other supplies or services will satisfy agency requirements as implemented by FAR 6.302-1. The U.S. Environmental Protection Agency (EPA), Office of Mission Support’s Acquisition and Grants Management’s Branch intends to issue a purchase order to PTS Professional Technical Services, Inc. d/b/a EST Analytical for an annual maintenance service agreement (silver).
The sole source nature of this requirement is based on the determination that PTS Professional Technical Services, Inc. d/b/a EST Analytical is the only organization that can support this requirement. Market research reflects that EST Analytical is the only source for the maintenance and repair services. No other source meets the requirement for the requirement maintenance service.
The determination not to compete this proposed contract action is solely within the discretion of the Government. Information received will normally be considered for the purposes of determining whether to conduct a competitive procurement. The Government will not be responsible for any costs incurred by responding to this notice.
