Total amount is anticipated to be substantially below the $250,000 threshold, and certainly will not exceed it. Description of goods or services: Consulting services specializing in proprietary materials and approaches to organizational change. 1. Background: This sole source justification applies to the purchase of: a) This single-award sole source Contract will provide proprietary materials and approaches that are unique to the Contractor. The work is grounded in established Human Resources, organizational development, and adult learning theory, and presented in a way unique to the Contractor from how those elements are integrated, operationalized, and applied in practice. The initial Work of the Contract will be an evaluation and analysis phase, followed by development of supports and recommendations. The initial cost of the Contract will be $30,000. Implementation, or “activation,” of those supports and recommendations, if approved, could ultimately raise the total amount of the Contract substantially. In no event shall the Contract exceed the $250,000 threshold. (6250-0) v2 / l.thomas Page 2 of 3 b) The consulting Work of the Contractor is separated into phases, each with its own expectations, culminating with “seeking input on Recommendations” and “Activate on Identified Areas,” which are implementation phases. It’s the implementation phase that may increase the total NTE of the Contract. c) The Director’s Office of the Oregon Department of Human Services has determined that the proprietary material and approaches utilized by this Contractor could prove beneficial to ODHS, and a decision was made for an initial foray into its material and approaches to assess for future uses. The material and approaches are proprietary to the Contractor and available from no other source. 2. Written findings of fact (market research): The findings below must include factual information supporting the determination that meet the sole source requirement in statute. Pursuant to ORS 279B.075, Agency must conduct market research that supports the assertion that there is only one source that can provide the goods or services. Market research includes utilization of the internet, trade journals, agency vendor lists, professional organizations, studies, catalogs/industrial periodicals, vendor sources, yellow pages, etc. Agency must select at least one of the findings and prepare the determination as it specifically relates to the good or service being procured. More than one finding can be addressed. The findings are as follows: Pursuant to ORS 279B.075 (2)(d): Any other findings that support the conclusion that the goods or services are available from only one source.
