Sole Source Procurements are unusual and should be considered an exception, as they are the most likely procurement method to receive a protest. A protest may be issued in accordance with OAR 137047-0710. In accordance with ORS 279B.075, NWCPUD may award a contract for goods or services without competition when the General Manager and/or his designees , after reviewing findings of fact, determines that the goods or services or class of goods or services, are allowable as sole-source and exempt from bidding. Determination must be based on written findings that may include: (a) ☒That the efficient utilization of existing goods requires the acquisition of compatible goods or services; (b) ☐That the goods or services required for the exchange of software or data with other public or private agencies are available from only one source; (c) ☐That the goods or services are for use in a pilot or an experimental project; or (d) ☐Other findings that support the conclusion that the goods or services are available from only one source, or (f) ☐Contracts for any item which is available only through one company, firm, or individual. (g) ☐Otherwise excluded under 6.5.1 of Rules and Policy document. By sole sourcing the procurement of like and kind materials from an exclusive dealer, we can reuse existing parts and materials that the district owns to achieve our office reconfiguration and additions to get to maximum capacity. This will eliminate the need to purchase another brand of furniture that is not compatible with our existing inventory.
