RFCQ Number – 00016379 2026 ESB US101: Fence Replacement (Gold Beach) Project 2 SECTION A – PROJECT AND SOLICITATION SUMMARY A.1 RFCQ PROCUREMENT SUMMARY. A.1.1 RFCQ PROCUREMENT SUMMARY. This solicitation and the resulting contract (“Contract”) shall be governed by and construed and enforced in accordance with the laws of State of Oregon without regard to principles of conflicts of law. Specific laws and rules that govern the solicitation process are found in Chapters 279A and 279C of the Oregon Revised Statutes (“ORS”), and Divisions 46 and 49 of the Administrative Rules (“OAR”) of the Oregon Department of Justice. The solicitation and resulting Contract may be subject to other laws and rules. A.1.2 RFCQ LIMITATIONS. This RFCQ is restricted to qualified contractors who have been certified by the State of Oregon as an Emerging Small Business (“ESB”) per the guidelines of the Certification Office for Business Inclusion and Diversity (“COBID”) and the subject project is part of the Emerging Small Business Assistance Program under ORS 200.160 through ORS 200.200. Only quotes from certified ESB firms will be considered for award of a Contract under this RFCQ. The selected ESB firm must comply with all ESB progra m requirements, including the following: ORS 200.170(3) Eligibility for Assistance. The applicant for assistance under ORS 200.005 and 200.160 to 200.200 must perform at least 51 percent of the labor on any public improvement or maintenance project for which assistance is received using the applicant's own workforce. A.1.3 RFCQ PURPOSE. The purpose of this RFCQ is to establish a Contract for one (1) qualified ESB contractor to rebuild 726 feet of Type 2 fence along US101 in Curry County, OR for the benefit of ODOT. The work contemplated under the Contract includes all labor, materials, transportation, equipment and services for, and incidental to, the completion of all construction Work in connection with the project described in the Contract Documents. Also see Attachment B (Plans, Specifications, and Project Requirements) for additional project information. A.1.4 PUBLIC WORKS REQUIREMENTS AND PUBLIC IMPROVEMENT REQUIREMENTS. If this is a Public Works project, all requirements applicable to Public Works project s apply to this project. In addition, ODOT has chosen to apply the requirements applicable to Public Improvement projects to this project whether or not it is a Public Improvement project. Therefore, throughout this RFCQ, wherever there is a reference to or requirement concerning Public Improvements, ODOT is applying the same requirement to the project, whether or not otherwise required by rule or statute. A.2 SINGLE POINT OF CONTACT (“SPC”) See “Purchaser” and “Info Contact”, including email address, for this RFCQ in OregonBuys. This is the only point of contact with this RFCQ. SUBSTANTIAL COMPLETION: June 15, 2026 FINAL COMPLETION: June 26, 2026 A.6 LIQUIDATED DAMAGES Liquidated damages will apply to the Contract resulting from this RFCQ for failure to complete the project by the Substantial Completion Date (see Attachment B, Sample Contract, Section 4). A.7 Reserved. A.8 PRE-QUOTE CONFERENCE No pre-Quote conference will be held. A.9 PUBLIC OPENING . No public Opening of Quotes will be held. RFCQ Number – 00016379 2026 ESB US101: Fence Replacement (Gold Beach) Project 4 SECTION B – DEFINITIONS Together with the definitions found in Section A.1 of the General Conditions, the following definitions apply to this RFCQ and the resulting Contract: "Addendum" (listed as an "Amendment" in OregonBuys) means an addition or deletion to, a material change in, or a clarification of, the RFCQ. Addenda will be labeled as such and will be made available to all interested Offerors in accordance with Oregon Administrative Rule (“OAR”) 137-049-0250(2). "Bid" means Quote and may be used interchangeably throughout the document to refer to an Offeror’s submission and requirements for this RFCQ. “Closing" (referred to as "Bid Opening Date" in OregonBuys) means the date and time set for Quote submission in response to this RFCQ, after which Quotes may not be submitted, modified, or withdrawn by Offeror. “Notice to Proceed” means the official written notice from Owner stating that the Contractor is to proceed with the Work defined in the Contract Documents. “Offer” means a Quote submitted in response to this RFCQ. “Offeror” means a “Person” (as defined in Section A.1 of the General Conditions) s ubject to ORS 279C that submits a Quote in response to this RFCQ. “Opening” means the date/time set to read the Quote submittals. "OregonBuys" means the online electronic Oregon Automated Procurement System administered by the State’s Department of Administrative Services. The OregonBuys System website is located at: https://oregonbuys.gov/bso/. “Quote” Refers to the full submission of the Competitive Quote Package (see Section C.3) and any information provided electronically on OregonBuys. “Request for Competitive Quote” or “RFCQ” means this document, including all exhibits, attachments and other documents referenced herein, whether attached or incorporated by reference, and any Addenda thereto, used for soliciting Quotes. "Signature" means one’s written name to confirm assent, responsibility, or obligation, either by hand using ink or by electronic means and constitutes an “electronic signature” under ORS Chapter 84. “Standard Drawings” means ODOT-prepared detailed drawings for Work or methods of construction that normally do not change from project to project. "State" means the State of Oregon. RFCQ Number – 00016379 2026 ESB US101: Fence Replacement (Gold Beach) Project 5 SECTION C – INSTRUCTIONS TO OFFERORS C.1 GENERAL QUOTE REQUIREMENTS. Offeror shall provide required information on the forms specified in this RFCQ. Offeror shall not make the Quote contingent upon the Owner’s acceptance of Specifications, Plans, or Contract terms that conflict with or are in addition to those advertised in this RFCQ. Offeror must select the “Yes” option on the Terms & Conditions tab in OregonBuys. If Offeror selects “Yes with exceptions” or “No”, the Quote will be rejected. C.2 SUBMITTALS VIA OREGON BUYS. Offeror must be a registered Vendor in OregonBuys (see Section C.5). Offeror should select the “Confidential” checkbox in OregonBuys when uploading any files required in response to this RFCQ. C.3 COMPETITIVE QUOTE PACKAGE. Offeror must complete and submit via upload to OregonBuys the following items, in accordance with all instructions in this RFCQ, no later than the Closing (Bid Opening Date specified in OregonBuys) in order to be considered for award. It is preferred that all documents (unless a pricing form has been provided in Excel) be submitted as one pdf attachment. Quotes submitted by any other means will be rejected. C.3.1 OFFEROR INFORMATION AND CERTIFICATIONS FORM. Offeror must complete and submit the Offeror Information and Certification Form provided as Attachment A, Form A-1. Failure to supply all required information in the Offeror Information and Certification Form may result in rejection of the Quote as nonresponsive. C.3.2 COMPETITIVE QUOTE PRICING. On-Line Pricing Entry. Offeror must complete online entry of all required pricing information specified in the “Item Information” section on the OregonBuys “Bid Solicitation” page for this RFCQ in OregonBuys. Failure to supply the required pricing information may result in rejection of the Quote as nonresponsive. In the event of a discrepancy between extended prices and unit prices, unit prices will prevail. If the Quote item information for this RFCQ is modified by an Addendum, then Offeror shall update pricing data entry on OregonBuys, as necessary, to address revisions. The quantities listed in the Item Information section for this RFCQ in OregonBuys for unit priced items are intended to serve only as a guide to Offerors and are not to be construed as a guarantee. Quantities are estimated and are for Quote purposes only. ODOT reserves the right to adjust quantities or delete items as needed. Payment for unit priced items will be made based on actual, measured quantities. C.4.3 ODOT reserves the right to award the Contract solely on the Quote submitted electronically through OregonBuys; however, upon ODOT’s request, the apparent successful Offeror shall promptly submit its complete original signed Quote. C.4.4 Per OAR 731-146-0150(4) in the event of a failu re of an Electronic Procurement System or email system that interferes with the ability to submit electronic Quotes or to otherwise participate in the procurement, ODOT may cancel the procurement or may extend the date and time of receipt of electronic Quotes by providing notice of the extension immediately after the Electronic Procurement System or email system becomes available. C.4.5 By submitting a Quote in response to this RF CQ, the Offeror (and if selected for award, also as the Contractor) agrees with ODOT that signatures, and other forms of authorized representative certification, showing on documents submitted via OregonBuys or email are “Electronic Signatures” under ORS Chapter 84 and bind the signing party and are intended to be and can be relied upon by the parties. C.5 OREGONBUYS REGISTRATION REQUIREMENT AND USER GUIDES. Offerors must be registered in OregonBuys to do business with the State. Registration is free.
