The purpose of the ITB is to establish a Contract for project: Intermediate BLDG Ceiling at OSP, 2605 State St. Salem, OR 97310
("Project"), for the benefit of Department of Corrections.
The Work contemplated under this Contract includes all labor, materials, transportation, equipment and services for, and
incidental to, the completion of all construction Work in connection with the project described in the Contract Documents.
A mandatory pre-bid conference will be held on 11/05/2025 at the "official time" of 9:00 AM (PST), located at OSP, 2605 State
St. Salem, OR 97310
Final Completion: One Hundred Fifty (150) Calendar Days from NOTICE TO PROCEED
Liquidated damages of $90.00 will apply to the contract resulting from this ITB. Failure to substantially complete the Project by
the, date of Substantial Completion, as specified in the Contract, will result in damage to the State of Oregon.
Moreover, failure to fully complete the Project by the date of Final Completion, as specified in the Contract, will also result in
damage to the State of Oregon Since actual damage will be difficult to determine, it is agreed that the Contractor shall pay to
the State of Oregon, not as a penalty but as liquidated damages, $90.00 per calendar day elapsed in excess of the Substantial
Completion date stated in Section 4 of the Agreement. Moreover, it is agreed that the Contractor shall pay to the
State of Oregon, not as a penalty but as liquidated damages, $90.00 per calendar day elapsed in excess of the Final Completion
date stated in Section 4 of the Agreement.

DOC reserves the right to reject any Bid that is unreadable.
DOC reserves the right to award the Contract solely on the Bid submitted electronically through OregonBuys;
however, upon DOC’s request, the apparent successful Bidder shall promptly submit its complete original signed
bid.
In the event of a failure of an Electronic Procurement System or email system that interferes with the ability to
submit electronic Bids, to protest or to otherwise participate in the procurement, DOC may cancel the
procurement or may extend the date and time of receipt of electronic Bids by providing notice of the extension
immediately after the Electronic Procurement System or email system becomes available.

BID REQUIREMENTS
Bidder shall provide required information on the forms specified in this ITB. Any information Bidder submits that
is not required to be included on forms prescribed by this ITB must be formatted in the manner called for in this
ITB and submitted on Bidder’s letterhead.
Bidder shall not make the Bid contingent upon the DOC’s acceptance of Specifications, Plans or Contract terms
that conflict with or are in addition to those advertised in this ITB. Bidder must select “Yes” on the Terms &
Conditions tab in OregonBuys or the Bid will be rejected.
SUBMITTALS VIA OREGONBUYS
Bidder must be a registered Vendor in OregonBuys (see section C.2.1). Bidder shall select the “Confidential”
checkbox in OregonBuys when uploading any files required in response to this ITB. Bidder must complete and

Inappropriate clothing includes suggestive, revealing, low-cut or skimpy clothing. Hats, wrap-around skirts,
halter tops, sheer or see-through clothing are not allowed. Other types of provocative clothing; camouflage of
any kind; and clothing, hairstyles, insignias or other paraphernalia associated with security threat groups or that
are inflammatory in nature are also not allowed.
Metal buttons, body piercings, jewelry, underwire bras, and some shoes may activate the metal detector. Avoid

specified in Section C.3.9.1.1. The protest shall include the legal and factual grounds for the protest, a description
of the resulting prejudice to the Bidder if the protest is not granted, and any proposed changes.
RESPONSE TO REQUESTS FOR CLARIFICATION: Clarifications, whether verbal, in writing, or included in an
Addendum or Amendment as a "clarification," do not change Plans, Specifications, contractual terms, or
procurement requirements of an ITB. If a request for clarification raises an issue that DOC determines should be
handled by formally amending the ITB, DOC will do so only by announcing such a change in an Addendum or
Amendment, not through information identified as a "clarification."
BRAND NAME: Any brand name listed in the specifications without an "or equal" "or approved equal" shall
establish the minimum requirements for quality, utility, durability, function, and purpose. Other brand names may
be used in the construction of the Project as long as they are equal to or better than the product brand named,
and the brand named is not mandated pursuant to a brand name exemption.

minimum requirements for quality, utility, durability, function, and purpose. Other brand names may be used in
the construction of the Project as long as they are equal to or better than the product brand named, and the
proposed product has been approved in writing by the Owner’s Authorized Representative prior to installation,
and the brand named is not mandated pursuant to a brand name exemption. The Owner’s Authorized
Representative shall determine, in its sole discretion, whether a product offered is "or equal".
BRAND NAME "OR APPROVED EQUAL": Any brand name listed in the specifications with an "or approved equal" or
an “or approved equivalent” designation shall establish the minimum requirements for quality, utility, durability,
function, and purpose. Other brand names may be used in the construction of the Project as long as they are equal
to or better than the product brand named, and the product has been pre-approved in writing during the bidding
process detailed in Section C.2, and the brand named is not mandated pursuant to a brand name exemption.
METHOD OF SUBMITTING REQUESTS FOR MODIFICATION OF ITB PROVISIONS: E-mail Addresses containing
requests for brand approval, requests for substitution, requests for clarification, requests for change, and Bid
protests shall be marked as follows:

REQUEST FOR APPROVAL OF AN "OR APPROVED EQUAL" OR AN "OR APPROVED EQUIVALENT": Pursuant to
Section C.3.8, Bidders shall provide that product unless another is approved through a request for approval of an
"or approved equal" or an "or approved equivalent, or a product exemption has been issued (ORS 279C.345).
Other brands of equal quality, merit and utility will be considered upon proper submittal of the request with
appropriate documentation.
Requests shall be made in writing and be submitted to the name of the single point of contact under C.3.2.1 of the
ITB document. To be considered, the request for changes must be received by the deadline specified in the
Solicitation Schedule
Requests shall provide all the information necessary for the State to determine product acceptability
Failure to provide sufficient information with the request shall be cause for the request not to be considered as

FORMS TO BE USED: Required information shall be submitted on the forms specified in the ITB. Any information
Bidder submits that is not required to be included on forms prescribed by DOC shall be formatted in the manner
called for in the ITB and submitted on Bidder's letterhead.
RESPONSE TO REQUESTS FOR BRAND APPROVAL, REQUESTS FOR SUBSTITUTION, REQUESTS FOR CHANGE AND
PROTESTS: DOC will promptly respond to each properly submitted written request for brand approval, request
for substitution, request for change, and protest. Where appropriate, DOC will issue ITB revisions via Addenda or
Amendment posted on OregonBuys System. DOC may also informally respond to Bidder’s questions. HOWEVER,
INFORMAL RESPONSES DO NOT AFFECT THE PROVISIONS OF THE ITB. PLANS, SPECIFICATIONS, CONTRACTUAL
TERMS, AND PROCUREMENT REQUIREMENTS OF THE ITB CAN ONLY BE CHANGED VIA ADDENDA or AMENDMENT
ISSUED BY DOC AND POSTED ON THE OregonBuys SYSTEM.
Requests for clarification, requests for change, and protests of Addenda must be received by the time and date
specified in the Addendum or they will not be considered. DOC will not consider requests or protests of matters
not added or modified by the Addendum.
SIGNATURE REQUIRED: All Bid documents requiring signature must be signed manually or electronically by an
authorized representative of the Bidder.
IN WRITING: Bids and pricing information shall be submitted using ODOC bid documents completed and filled
using computer generated digits, characters, and format. Bids must be manually or electronically signed by an
authorized representative of the Bidder. No other forms of Bids will be accepted.

NUMBER OF COPIES; SIGNATURE REQUIRED: Bidders shall submit a total of 1 copy of the Bid via Oregon Buys. Bid
submitted by Bidder must bear the signature of the Bidder’s Authorized Representative. Failure to submit an Bid
bearing an original signature will result in rejection of the Bid.

C.16 REJECTION OF BIDS
TIME FOR BID ACCEPTANCE An Bidder's Bid is a firm Bid, irrevocable, valid and binding on the Bidder for not less
than Thirty (30) calendar days from the Closing date.
EXTENSION OF TIME FOR BID ACCEPTANCE DOC may request, orally or in writing, that Bidders extend, in writing,
the time during which DOC may consider their Bids. If an Bidder agrees to such extension, the Bid shall continue as
a firm Bid, irrevocable, valid and binding on the Bidder for the agreed-upon extension period.
METHOD OF AWARD
METHOD OF BID AWARD: Award will be made to the responsive and responsible Bidder submitting the lowest
total BASE BID. The State reserves the right to reject all Bids.
BID ALTERNATE AWARDS UP TO 10 CALENDAR DAYS PRIOR TO THE DATE OF SUBSTANTIAL COMPLETION: Agency,
in its sole discretion, may issue a Notice to Proceed and authorize any or all alternate bid items. Contractor shall
perform all the authorized alternate bid items for the prices established in Exhibit 1 to this Contract and in
accordance with the terms and conditions of this Contract. Contractor shall not be entitled to any additional
compensation.
BID ALTERNATE AWARDS WITHIN 10 CALENDAR DAYS PRIOR TO THE DATE OF SUBSTANTIAL COMPLETION:
Agency, in its sole discretion, may issue a Notice to Proceed and authorize any or all alternate bid items.
Contractor shall perform all the authorized alternate bid items for the prices established in Exhibit 1 to this
Contract and in accordance with the terms and conditions of this Contract. Contractor may be entitled to
additional compensation, additional time, or both, pursuant to the execution of a Change order to cover the cost
ancillary to the performance of alternate bid items under this Contract.
SUBSTANTIAL COMPLIANCE REQUIRED Bidders not in substantial compliance with ITB requirements cannot be
considered and cannot be supplemented by submissions delivered after Closing. However, DOC may waive minor
informalities and irregularities, and may seek clarification of any response that, in its sole discretion, it deems
necessary or advisable.
BID EVALUATION CRITERIA Bids will be evaluated to identify the lowest responsive Bid submitted by a responsible
Bidder and not otherwise disqualified. (Refer to OAR 137-049-0390). Adjustments made to account for reciprocal
preferences will be for Bid evaluation purposes only. No such adjustments shall operate to amend Bidder's Bid or
any Contract awarded pursuant thereto.
RESPONSIVENESS: To be considered responsive, the Bidder must substantially comply in all material respects with
applicable solicitation procedures and requirements and the solicitation documents. In making such evaluation,
DOC may waive minor informalities and irregularities.
RESPONSIBILITY: Prior to award of a Contract, DOC will evaluate whether the apparent successful Bidder meets
the applicable standards of responsibility identified in OAR 137-049-0390. In doing so, DOC may investigate Bidder
and request information in addition to that already required in the ITB, when DOC, in its sole discretion, considers
it necessary or advisable.
OREGON PREFERENCE: Awards shall be subject to preference for products produced or manufactured in Oregon, if
price, fitness and quality are equal; and, solely for the purpose of evaluating Bids, DOC will add a percent increase
to the Bid of a non-resident Bidder equal to the percent, if any, of the preference given to the Bidder in the state in
which the Bidder resides. For example, if the Bidder is from a state that grants a ten (10) percent preference to
local Bidders, DOC will add ten (10) percent to that Bidder's Bid price. (OAR 137-046- 0300, 137-046-0310 and
137-049-0390).
REJECTION OF BID DUE TO CERTAIN DEBT: Included among the reasons DOC may reject a Bid is if the Bidder has
liquidated and delinquent debt owed to the State or any department or agency of the State.
PROCESSING OF BIDS Neither the release of a Bid Security, nor acknowledgment that the selection process is
complete (whether by posting of a Bid tabulation sheet, issuance of notice of intent to award, or otherwise), shall
operate as a representation by DOC that any Bid submitted was complete, sufficient, lawful in any respect, or
otherwise in substantial compliance with the ITB requirements.
WITHDRAWAL BY DOC OF BID ITEMS PRIOR TO AWARD DOC reserves the right to delete Bid items. The deletion
of one or more Bid items will not affect the method of award.
BIDDER QUALIFICATIONS. If requested by Agency after Bid opening, notified Bidders shall submit the additional
information per request within two business days of Agency’s request, to assist Agency in its determination of
BIDDER responsibility. Failure to submit this information by the established deadline will be grounds for rejection
of the Bid as non-responsive.
PRELIMINARY BID RESULTS Prior to the Intent to Award Announcement, DOC may post preliminary bid results on
OregonBuys System. Such postings may not be correct and are not final.
Due to conditions or circumstances beyond Agency’s control such as public safety concerns, Agency may elect to
not hold in-person public bid openings. Agency, in its sole discretion and in lieu of an in-person public bid opening,
may provide electronic options including, but not limited to, “real time” skype, zoom, or video recording of the
public opening. To the extent practicable, Agency will publish advance notice of “real time” electronic public bid
opening as an addendum on OregonBuys System or will directly notify bidders in standing using other means
available to the Agency or both
FIRST TIER SUBCONTRACTOR DISCLOSURE FORM: First tier subcontractor disclosure forms must be returned
within two working hours after the Closing, via email to the single point of contact (see, section C.5.4). Failure to
comply with this requirement shall result in rejection of the Bid as non- responsive.

PROTEST OF INTENT TO AWARD Adversely affected or aggrieved Bidders shall have 7 calendar days from the
OregonBuys posting date and time of the Intent-to-Award Announcement within which to file a written protest.
Protests submitted after that date and time will not be considered. Protests must specify the grounds upon which
the protest is based.
In order to be an adversely affected or aggrieved Bidder, the Bidder must claim to be eligible for award of the
Contract as the lowest responsible and responsive Bidder and that any and all lower Bidders are ineligible to
receive Contract award.
An actual Bidder who is adversely affected or aggrieved by the award of the Contract to another Bidder may
protest award, in writing, within the timeline established. The written protest shall state the grounds upon which
the protest is based. No protest of award shall be considered after the deadline.
Pursuant to OAR 137-049-0260, no protest against award shall be considered because of the content of Bid
Specifications, Plans, or contract Terms after the deadline established for submitting protests of Bid Specifications,
Plans or Contract Terms
RESPONSE TO INTENT-TO-AWARD PROTESTS DOC will respond in writing to intent-to-award protests submitted
by adversely affected or aggrieved Bidders. DOC may also respond to intent-to-award protests submitted by other
Bidders for purposes of clarification. However, any response provided by DOC is not intended to, and shall not in
and of itself constitute, confirmation that the Bidder is, in fact, adversely affected or aggrieved, and therefore
entitled to protest an intent to award, or that the protest was timely filed.
AWARD After expiration of the 7 calendar-day intent-to-award protest period, and resolution of all protests, DOC
will proceed with final award. (If DOC receives only one Bid, DOC may dispense with the intent-to-award protest
period and proceed with award of a Contract.)
COMMENCEMENT OF WORK Contractor shall not commence Work under the Contract until the Notice to Proceed
has been issued.
REVIEW OF BID FILES Bid files are public records and available for review on Oregon Buys website
INSURANCE: The apparent successful Bidder shall provide all required proofs of insurance to DOC within 10
calendar days of notification of intent to award. Failure to present the required documents within the 10
calendar-day period may result in Bid rejection. Bidders are encouraged to consult their insurance agent(s) about
the insurance requirements as identified in Section G.3 of the General Conditions and the Supplemental General
Conditions in Exhibit 6 and Exhibit 7 respectively, prior to Bid submission.
Bidders must satisfy these insurance requirements by obtaining insurance coverage from insurance companies or
entities acceptable to State that are allowed to provide such insurance under Oregon law. Eligible insurers include
admitted insurers that have been issued a certificate of authority from the Oregon Department of Consumer and
Business Services authorizing them to do an insurance business in the state of Oregon, and certain nonadmitted
surplus lines insurers that satisfy the requirements of applicable Oregon law and are approved by DOC. DOC's
approval will be based on its assessment of the nonadmitted surplus lines insurer and the suitability of surplus
lines insurance for this particular procurement.
PERFORMANCE BOND and PAYMENT BOND: The successful Bidder shall be required to furnish electronic copies of
the original Performance Bond and a Payment Bond each in the total amount (100%) of the awarded Contract,
executed in favor of the State of Oregon, to ensure faithful performance of the Contract and payment for services
and goods.
NOTE: THE DOC PROVIDED PERFORMANCE AND PAYMENT BONDS ARE THE ONLY FORMS APPROVED AND
REQUIRED TO BE USED FOR THIS ITB.
The State of Oregon Performance Bond and Payment Bond form are Exhibits 3 & 4, respectively.
The apparent successful Bidder shall provide all required bonding to the Department of Corrections, Purchasing
Section (DOC) within 10 calendar days of notification of award. Failure to present the required documents within
10 calendar days may be grounds for award disqualification.
JOINT VENTURE/PARTNERSHIP INFORMATION: The apparent successful Bidder, if a Joint Venture/Partnership,
shall provide a copy of the joint venture agreement or partnership agreement evidencing authority to Bid and to
enter into the resulting Contract that may be awarded, together with corporate resolutions (if applicable)
evidencing corporate authority to participate as a joint venturer or partner. A contact person must also be
designated for purposes of receiving all notices and communications under the Contract. All partners and joint
venturers will be required to sign the Contract awarded
REJECTION OF PARTICULAR BIDS: DOC may reject a particular Bid for any of the reasons listed under OAR
137-049-0440.
LIQUIDATED AND DELINQUENT DEBT: DOC may reject a particular Bid if an Bidder has liquidated and delinquent
debt owed to the State or any department or agency of the State.
INTENT-TO-AWARD ANNOUNCEMENT DOC reserves the right to announce its intent to award prior to formal
Contract award by posting the tabulation sheet of Bid results on OregonBuys System The Intent-to-Award
Announcement shall serve as notice to all Bidders that DOC intends to make an award.
REJECTION OF ALL BIDS: DOC may reject all Bids for good cause upon its finding that it is in the public interest to
do so.

Bid Security shall be furnished to the Department of Corrections as security against the failure of the undersigned
to comply with all requirements within the time frames established subsequent to notification of award.
If the undersigned fails to (1) execute the Contract, (2) furnish a Performance Bond and a Payment Bond, or (3)
furnish certificates of insurance within 10 calendar days of the written notification of intent to award a Contract,
then the DOC may cash the check, draw under the letter of credit or otherwise collect under the Bid Security.
If Bid Security furnished by means of a Bid Bond, the State of Oregon Bid Bond form, provided as Exhibit 2, is the
form approved and required to be used for this ITB and submitted via upload in OregonBuys.
DOC may cash the check, draw under the letter of credit, or otherwise collect under the Bid Security, if any of the
following occur:
Bidder fails to furnish a Performance Bond and a Payment Bond within the time specified in the written
notification of intent to award a Contract, or
Bidder fails to furnish certificates of insurance within the time specified in the written notification of intent to
award a Contract, or
Bidder fails to execute the Public Improvement Agreement form within the time specified in Section C.24.
CERTIFICATE OF PAY EQUITY TRAINING In accordance with ORS 279A.167the apparent successful Bidder must
submit to DOC within 90 calendar days of notification of intent to award, a true and correct copy of an unexpired
certificate, issued to the Bidder by the Oregon Department of Administrative Services under 2015 Oregon Laws,
chapter 454, section 2. This requirement applies only to Bidders that employ 50 or more full-time workers and
only if the Contract has an estimated contract price that exceeds $500,000. For more information regarding

EXECUTION OF AGREEMENT FORM Notwithstanding the requirements of C.23.4,once all items required under
Section C.23 have been received from the apparent successful Bidder and accepted by DOC, DOC will finalize and
email the Public Improvement Agreement Form to the Bidder, which the Bidder shall sign and return by email as
soon as possible, and within 2 business days of receipt. DOC will then sign the Public Improvement Agreement
Form and email a fully executed copy of it to the Bidder.
Each Bid shall be accompanied by a certified or cashier's check, irrevocable letter of credit (issued by an insured
institution as defined in ORS 706.008, or Original Bid Bond payable to the Department of Corrections (“DOC”) in an
amount equal to ten percent (10%) of the total amount of the Bid. If Bidder wants to submit a certified or cashier's
check, irrevocable letter of credit in lieu of all or a portion of the required bid bond, the Bidder shall contact the
Single Point of Contract for instructions.
AREA RESERVED – NO FEDERAL FUNDING USED IN THIS PROJECT
The Contractor and all subcontractors shall comply with the provisions of ORS 279C.800 through 279C.870,
relative to Prevailing Wage Rates, as outlined in Sections C.1, C.2 and G.2.3 of the General Conditions Public
Improvement Contracts & Supplemental General Conditions Exhibit 6 & Exhibit 7. Before starting Work the
Contractor shall file with the Construction Contractors Board, and maintain in full force and effect, the separate
public works bond required by ORS 279C.836 and OAR 839-025-0015, unless otherwise exempt under those
provisions. The Contractor shall also include in every subcontract a provision requiring the Subcontractor to have a
public works bond filed with the Construction Contractors Board before starting Work, unless otherwise exempt,
and shall verify that the Subcontractor has filed a public works bond before permitting the Subcontractor to start
Work.
