Description

Provide consultation services on DPA client cases that involve immigration collateral consequences of a criminal matter. Review provided facts and circumstances around criminal cases involving non-citizen clients to determine immigration consequences. Advise criminal defense attorney public defenders on potential collateral consequences, possible ways to avoid any negative outcomes, and how to properly explain collateral consequences to clients. In limited circumstances, assist in advising prosecutors, the court, and clients on immigration consequences associated with a criminal matter. Assist in educating defenders on immigration consequences for non-citizen clients facing criminal legal consequences, including any recent changes in immigration that may impact DPA non-citizen clients. Attend case reviews or meetings involving non-citizen clients facing immigration consequences. Work with DPA attorneys, clients, and teams will be subject to confidentiality and is designed to ensure compliance with the constitutional requirements of Padilla v. Kentucky, 559 U.S. 356 (2010).
