Bids received after this time will not be accepted. The time of receiving and opening bids may be postponed due to emergencies and unforeseen conditions. Bids must be submitted in a SEALED envelope, clearly marked with the following information: Construct Aircraft Fuel Facility Belfast Municipal Airport AIP No. 3-23-0007-XXX-2021 <Bidder’s Company Name> <Bidder’s Address> Bid Date: Tuesday, March 30, 2021, 3:00 pm Attn: Manda Cushman, City Manager’s Office Bids submitted by FedEx, UPS, or other parcel delivery service shall have the SEALED envelope containing the Bid Proposal placed inside the shipping carton. PHYSICAL LOCATION: Belfast Municipal Airport, 22 Wright Brothers Drive, Belfast, Maine 04915 TYPE OF CONSTRUCTION: Base Bid - Construct Aircraft Fuel Facility with 1 - 12,000-gallon JetA and 1 - 12,000-gallon AvGas Fueling Systems, Alternate 1 – Add Tank Monitoring System, Alternative 2 – Reduce One Tank to - 10,000-gallons, Alternate 3 – Reduce One Tank to 8,000-gallons, Alternate 4 - Reduce One Tank to 6,000-gallons. COMPLETION: The contract time for completion of all work is within forty-five (45) calendar days of the date specified in the “Notice to Proceed” for Base Bid and for Base Bid and any combinations of Alternates 1, 2, 3 and 4. PROPOSAL SURETY: All bids must be accompanied by a Proposal Surety (Bid Bond or other instrument as described in the Instructions to Bidders). Proposal Surety of the 2 lowest responsible Bidders that have submitted proposals that comply with all the provisions required to render them formal will be retained until the Contract and Bonds have been signed by all parties. Proposal Surety of all other bidders will be returned or released as soon as it is practical. QUESTIONS AND CONTACT WITH THE OWNER: From the time of advertising until the actual bid opening for this Contract, all prospective Bidders, Contractors, Subcontractors, and Suppliers shall direct all inquiries related to this project solely to Dave Brouillet, McFarland Johnson, 53 Regional Drive, Concord, NH 03301, 603-225-2978, . The deadline for submitting inquiries related to this project is March 24, 2021. MINIMUM LABOR AND TRUCK RATES (DAVIS-BACON): All work under this project must comply with Davis-Bacon Act regulations as described in the Contract Documents. Federal Wage Rates are included in the Contract Documents. BIDDING PROCEDURES: The Bidding Procedures as outlined in the Instructions to Bidders. CONTRACT BONDS: A successful Bidder entering into a contract for any portion of the work included in a proposal shall provide the Owner sufficient surety in the form of 100% Performance and Payment Bonds as outlined in the Supplemental General Provisions. NONDISCRIMINATION IN CONTRACTS: The Owner will not discriminate against any bidder because of race, color, religion, sex, or national origin. CIVIL RIGHTS: The Contractor agrees to comply with pertinent statutes, Executive Orders and such rules as are promulgated to ensure that no person shall, on the grounds of race, creed, color, national origin, sex, age, or disability be excluded from participating in any activity conducted with or benefiting from Federal assistance. This provision binds the Contractor and subcontractors from the bid solicitation period through the completion of the contract. This provision is in addition to that required by Title VI of the Civil Rights Act of 1964. PRE-BID CONFERENCE: A Pre-Bid Conference will be held at the Belfast Municipal Airport, 22 Wright Brothers Drive, Belfast, Maine 04915 on Thursday, March 18, 2021 at 11:00 a.m. Please notify Paige Kingsley at at least one day prior to the meeting if you plan to attend. FEDERAL CONTRACT PROVISIONS: In this bid process and the resulting Contract, if executed, all Bidders and Contractors must fully comply with the Contact Provision Guidelines for Obligated Sponsors and Airport Improvement Program Projects referenced in the Contract Documents. LOBBYING AND INFLUENCING FEDERAL EMPLOYEES: Contractors that bid on this project must certify that they will not and have not used Federal appropriated funds to pay any person or organization for influencing or attempting to influence an officer or employee of any agency, a member of Congress, officer or employee of Congress, or an employee of a member of Congress in connection with obtaining any Federal contract, grant, or another award covered by 31 USC 1352. Each Contractor and Subcontractor must also disclose any lobbying with non-Federal funds that takes place in connection with obtaining any Federal award. PROCUREMENT OF RECOVERED MATERIALS: Contractors and subcontractors that bid on this project agree to comply with Section 6002 of the Solid Waste Disposal Act, as amended by the Resource Conservation and Recovery Act, and the regulatory provisions of 40 CFR Part 247 as defined in the Contract Documents. DISADVANTAGED BUSINESS ENTERPRISE (DBE): The requirements of 49 CFR part 26 apply to this contract. It is the policy of the City of Belfast, Maine at the Belfast Municipal Airport to practice nondiscrimination based on race, color, sex, or national origin in the award or performance of this contract. The Owner encourages participation by all firms qualifying under this solicitation regardless of business size or ownership. The Contractor must comply with the Federal DBE, Small Business, Equal Employment Opportunity (EEO), and Affirmative Action Requirements contained within the Contract Documents. 2021 Aviation projects sponsored by the City of Belfast Maine at the Belfast Municipal Airport utilize race-neutral DBE procedures. There is no specific DBE goal for this project. Bidders must comply with the requirements of 49 CFR Part 26, including Appendix A, which discusses making good-faith efforts, to ensure that all DBE’s and Small Businesses are afforded the maximum opportunity to work with them on federally funded projects. The City of Belfast, Maine has an overall DBE goal of 3.5% for FAA funded projects in Federal Fiscal Year 2021. NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION to ENSURE EQUAL EMPLOYMENT OPPORTUNITY: 1. The Offeror’s or Bidder’s attention is called to the “Equal Opportunity Clause” and the “Standard Federal Equal Employment Opportunity Construction Contract Specifications” set forth herein. 2.
